Database (“the Database”) contained on the Commonwealth of Learning’s Web site is subject to the Terms of Use and Disclaimer Agreement.

This is an agreement between you (“you”) and The Commonwealth of Learning (“COL”).  The effective date of this Agreement is when you accept this Agreement in accordance with the procedure set out herein.  COL may revise this agreement at any time by updating this posting. 

The Commonwealth of Learning (COL) Web site contains a database of personnel who have identified themselves as experts in certain fields, and who have asked to be registered in the ‘Sharing Our Services’ Database.  COL has not checked or verified the information in the Database including the qualifications, expertise reputation or character of any persons in the Database.  COL does not accept any responsibility for the content of the Database, for any correspondence between you and people listed in the Database, or for the consequences of any actions you may take in relying upon information provided by a person whose name appears in the Database.  Opinions or views expressed by a person whose name appears in the Database are the opinions or views of that person and are not of COL.

The services provided under the Database are provided for educational or informational purposes only and are not intended to provide legal, consulting, management or career advice and should not be interpreted as a recommendation for any specific product or service, use or course of action.  You are solely responsible for the retrieval and use of any information or content expressed or made available on the COL Web site.

You acknowledge that the Internet is not a secured medium and privacy cannot be ensured, the Internet is vulnerable to interception and forging and COL will not be responsible for any damages you or any third party may suffer as a result of the transmission, storage or receipt of confidential or proprietary information that you make to COL or for any errors or any changes made to any transmitted information.  You acknowledge that all information you submit to COL contains an express consent from you for COL and others to use such information and such information will not be kept confidential. 

While COL makes efforts to ensure that all information provided on the COL Web site do not contain computer viruses, you are responsible to take the appropriate precautions to scan for computer viruses.

You agree at all times to indemnify, defend and hold harmless COL, its respective agents, affiliates and their respective governors and employees against all actions, proceedings, costs, claims, damages, demands, liabilities and expenses whatsoever sustained or incurred in respect of any information or other content you provide on or through the Database.
